Please read these rules before entering the ADRIAN BALLINGER SWEEPSTAKES. You agree that by submitting an entry, you acknowledge that you are bound by these rules, and you certify that you satisfy all eligibility requirements set forth herein.
ELIGIBILITY: No purchase is necessary to enter or win the Sweepstakes. This Sweepstakes is open to legal residents of the United States only, excluding residents of Puerto Rico and other U.S. territories. This Sweepstakes is void where prohibited by law. You must be 18 years or older at the time of this Sweepstakes to be eligible to enter, and you must possess a valid form of identification. Sponsor and Sponsor’s parents’ and affiliates’ employees and their immediate family members (parents, spouses, children, siblings, or grandparents) are NOT eligible to participate in the Sweepstakes.
HOW TO ENTER: During the Sweepstakes Period (defined below), a participant may enter by (i) following the @vuarnetofficial and @adrianballinger Instagram accounts; and (ii) commenting and tagging two (2) friends on one of the Instagram posts posted during the Sweepstakes Period on the Instagram accounts @vuarnetofficial or @adrianballinger. Entry is limited to one (1) entry per person. Entrants may not create multiple entries through use of numerous Instagram accounts or use of multiple email addresses. Commenting and tagging friends on multiple posts will not result in multiple entries, and only one (1) entry will be counted as eligible for purposes of the drawing.
Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, communication transmissions, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer or mobile device relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes. Cellphone carriers may charge for data usage for entering the Sweepstakes using a mobile phone.
Entry by Email/Mail: To enter by email, send an email with the subject line ADRIAN BALLINGER SWEEPSTAKES to brucker.lara@vuarnet.us with your name, complete address and telephone number (including area code). All email entries must be received by January 28, 2024 at 11:59 p.m. EDT to be eligible for entry. To enter by mail, print your name, complete address, email address (if applicable) and telephone number (including area code) on a 3” x 5” card and mail it with proper postage to: 420 Columbus Avenue, Suite 301, Valhalla, NY 10595 USA. All mail-in entries must be received no later than January 28, 2024 to be eligible for entry.
MAILING LIST: By entering this Sweepstakes, you agree to receive newsletters and other promotional material from Sponsor. You may update your newsletter subscription preferences upon receipt of any newsletter email from Sponsor.
TIMING: Sweepstakes begins on January 26, 2024 at 12:01 a.m. EDT and ends on January 28, 2024 at 11:59 p.m. EDT (the “Sweepstakes Period”). No entries will be accepted after January 28, 2024 at 11:59 p.m. EDT.
PRIZES AND ODDS: At the end of the Sweepstakes Period, one (1) winner (the “Winner”) will be selected by a random drawing from all eligible entries received during the Sweepstakes Period. The Winner shall be awarded one (1) pair of Vuarnet Snow Goggles of the Winner’s choosing among the products sold on the Sponsor’s website https://us.vuarnet.com/collections/goggles, subject to stock availability (the “Prize”). The maximum retail value of the Prize is $330.
Odds of winning the Prize will depend upon the number of eligible entries received.
The Prize is nontransferable and must be accepted as awarded. No substitutions, cash equivalents, or transfer of the Prize are permitted, except at the sole discretion of the Sponsor, who reserves the right to substitute the Prize (or portion thereof) with one of comparable or greater value. The Winner will be solely responsible for all taxes (federal, state, and local) and all expenses not listed herein as being provided as part of the Prize related to acceptance and use of the Prize. The Prize will be awarded only if properly claimed. Limit one (1) Prize per household. Unclaimed Prizes will be forfeited.
In the unlikely event that the Prize is unavailable for any reason beyond Sponsor’s reasonable control, the Winner agrees that Sponsor shall have no further obligation to the Winner.
NOTIFICATION, RESPONSE REQUIREMENTS: Drawing of the Winner will be made no later than January 29, 2024through the use of on-line software which will randomly select a winner from the eligible participants. We will notify Winner via email or by direct message on Instagram within approximately twenty-four (24) hours of the drawing. “Notification” is deemed to have occurred immediately upon sending a direct message or an e-mail to the entrant. Within forty-eight (48) hours] of notification, the Winner must complete, execute and return to Sponsor any tax form, affidavit, waiver, release, indemnity agreement, and/or any additional documents required by Sponsor in Sponsor’s sole discretion and/or required by applicable tax authorities. Failure to comply with the requirements of this paragraph (or the return of the Prize or notification as non-deliverable) may result in disqualification and in the forfeiture of any right to the Prize, in which case the Prize will be awarded to an alternate participant by random drawing.
The Prize will be awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). Eligible entries are those in which all entries have been completed correctly and otherwise comply with these Official Rules. Sponsor reserves the right to disqualify any participant or Winner and may refuse to award the Prize to a person who is ineligible or has violated any rule, gained unfair advantage in participating in the Sweepstakes, or obtained winner status using fraudulent means.
The Sponsor will choose the means it deems most appropriate to deliver the Prize to the Winner, including without limitation by overnight courier. Sponsor expressly disclaims any liability arising out of any delay or failure to deliver the Prize due to reasons beyond Sponsor’s reasonable control, including without limitation interruption, defect or delay in operation or transmission over the Internet, electronic or electrical interference, system failure or computer virus, or any delays or delivery failures caused by weather conditions, fire, strikes, boycotts, delays in transportation, etc. if the Prize is delivered by overnight courier.
NAME OF THE WINNER: The name of the Winner will be available for twelve (12) months after award of the Prize by sending an email to brucker.lara@vuarnet.us or a self-addressed envelope with sufficient prepaid postage to:

RELEASE: By participating in the Sweepstakes and/or accepting the Prize, a participant/Winner agrees to defend, release and hold harmless the Sponsor, Instagram and each of their respective parents, subsidiaries, affiliates, divisions, advertising and promotion agencies, and the foregoing companies’ officers, directors, shareholders, employees, representatives and agents (collectively “Releasees”) from and against any actions, claims and/or liability for injury, loss or damage of any kind, (including the violation or infringement of any proprietary or personal right of any individual or entity) resulting in whole or in part, directly or indirectly, from participation in the Sweepstakes, and/or the use, acceptance, or possession of the Prize, and/or participation in a Sweepstakes prize-related activity, including any action, claim or liability arising from the unauthorized submission of any information.
By participating in the Sweepstakes and/or accepting the Prize, a participant/Winner consents to and gives the Sponsor the right to use, publish, and display the Winner’s (and where applicable a participant’s) full name, city and state, and Prize awarded, for advertising, trade, publicity and/or promotional purposes, in any media now known or hereafter discovered, worldwide, and on the Web, without review, notification or approval, all without additional consideration, unless prohibited by law.

The parties hereby consent to exclusive jurisdiction and venue of the courts located in New York County, New York in any action to enforce (or otherwise relating to) these Official Rules or relating to this Sweepstakes.
GENERAL: Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision.
